Automobile Warranties
The Consumer Arbitration Program (CAP-Motors) is a free service for owners of automobiles with warranty disputes.
The CAP-Motors program offers mediation and arbitration to eligible consumers and participating manufacturers. These services, provided by experienced professionals, help resolve disputes involving vehicles covered under the Magnuson-Moss Warranty Act and applicable state lemon laws, within 40 days.
Mediation
In mediation, the parties are invited to discuss the dispute and jointly develop a resolution with the assistance of a neutral third party. Mediation often precedes arbitration. The mediation component is a voluntary process available when requested by both parties.
Arbitration
In arbitration, the parties bring their case to an attorney Arbitrator who reviews the complaint and makes a decision. During this step the consumer and manufacturer present their cases to the Arbitrator at a mutually agreed upon location. In order to make his decision, the Arbitrator will review all supporting documents provided by the parties. Once accepted by the consumer, arbitrated decisions are binding on the manufacturer.
Neutrals
The Arbitrators and Mediators are professional attorneys trained on the Magnuson-Moss Warranty Act, local state lemon laws, and the specific rules and guidelines of the CAP-Motors program.
